Terms & Conditions of PowerElite Real Estate
1. Definitions
- "Company," "We," "Us," "Our" refers to PowerElite
- "Client," "You," "Buyer," "Tenant," "Seller," "Landlord" refers to any individual or entity using our services.
- "Property" includes residential, commercial, and rental real estate listed with us.
- "RERA" refers to the Real Estate Regulatory Agency of Dubai.
2. General Terms
2.1 Compliance with UAE Laws
All transactions are subject to the laws of the UAE, including:
- Dubai Real Estate Laws
- RERA Regulations
- Tenancy Laws (Law No. 26 of 2007, amended by Law No. 33 of 2008)
- Anti-Money Laundering (AML) Policies
2.2 Brokerage Services
- We act as an intermediary between buyers, sellers, landlords, and tenants.
- We do not guarantee property availability, pricing, or ownership disputes.
- Clients must verify property details independently before transactions.
2.3 Client Responsibilities
- Provide accurate information for contracts and due diligence.
- Ensure financial readiness (pre-approvals for mortgages, rental budgets, etc.).
- Comply with UAE visa and residency requirements for property ownership.
3. Property Listings & Transactions
3.1 Accuracy of Information
- Property details (pricing, size, amenities) are provided by owners/developers.
- We are not liable for discrepancies but will assist in verifications.
3.2 Exclusive Listings
- Sellers/Landlords granting exclusivity must sign a RERA-approved mandate.
- Early termination may incur fees unless mutually agreed.
3.3 Buyer/Tenant Obligations
- A good faith deposit (usually 5-10%) may be required to reserve a property.
- Non-refundable agency fees (2-5% of sale price or 5% of annual rent) apply upon deal closure.
4. Fees & Payments
4.1 Commission Structure
- Sales: 2% of the property price (per RERA guidelines).
- Rentals: 5% of the annual rent (paid by the tenant unless otherwise agreed).
- Commercial Leases: Negotiable (typically 5-10% of lease value).
4.2 Payment Terms
- Due upon contract signing or transaction completion.
- Late payments may incur AED 500 + 1% monthly interest.
5. Cancellations & Refunds
5.1 Buyer/Tenant Cancellation
- Deposits are non-refundable unless the seller/landlord defaults.
- Agency fees are due if a deal is canceled post-agreement.
5.2 Seller/Landlord Cancellation
- If a property is withdrawn after marketing, a cancellation fee (up to 50% of commission) may apply.
6. Data Privacy & Confidentiality
- Personal data is collected per UAE Data Protection Laws.
- We do not share client details without consent, except for legal compliance.
7. Dispute Resolution
- Disputes will first undergo mediation via RERA or DLD.
- Unresolved cases will proceed to Dubai Courts.
8. Amendments
- We reserve the right to modify these terms with 30 days’ notice.
